Nature of Services

Activate This Plan, LLC provides educational and advisory services, including structured coaching and mentoring. Services may include instructional video content, live one on one coaching or consulting sessions, questionnaires, quizzes, assessments, written materials, presentations, worksheets, proprietary systems, and related content. All services are educational and advisory in nature only. Activate This Plan does not provide legal, medical, psychological, therapeutic, financial, or investment advice.

No Guarantees

No guarantees of outcomes, earnings, income, results, success, or performance of any kind are made or implied. Any examples, illustrations, or case studies are provided strictly for educational purposes. Your results depend entirely on your own actions, decisions, effort, consistency, and external factors beyond the control of Activate This Plan.

Client Responsibility

You are solely responsible for your participation, attendance, implementation, and completion of assigned materials, as well as all decisions made based on the information provided. Failure to participate or complete materials does not constitute a breach by Activate This Plan.

Qualification and Acceptance

Completion of any quiz or assessment does not guarantee acceptance into services. Activate This Plan reserves the sole right to accept or decline clients, limit or modify services, determine readiness for progression, or discontinue access at its discretion.

Payment and Refunds

All payments are governed by the Activate This Plan Refund Policy, which is incorporated into these Terms by reference. All sales are final and non refundable as outlined in the Refund Policy.

Intellectual Property Notice

All content, materials, systems, methodologies, frameworks, processes, strategies, written content, designs, branding elements, graphics, videos, downloads, digital products, course materials, presentations, worksheets, coaching structures, advisory systems, staged processes, and proprietary models collectively referred to as the Materials are the exclusive intellectual property of Activate This Plan, LLC. These Materials are protected under United States copyright law including Title 17 U.S.C., applicable Florida state law, federal trademark and trade secret laws, and international intellectual property treaties including the Berne Convention. No ownership rights are transferred to any user, client, or visitor.

Limited License

Users are granted a limited, non exclusive, non transferable, revocable license to access and use the Materials solely for personal educational purposes. No reproduction, redistribution, republication, resale, derivative creation, public display, commercial exploitation, reverse engineering, AI training, machine learning ingestion, automated extraction, storage in retrieval systems, recording for redistribution, replication, reselling, or creation of derivative programs based on Activate This Plan methodologies is permitted without prior written authorization.

Anti Scraping and Data Extraction Prohibition

Automated scraping, crawling, harvesting, data mining, screen scraping, AI ingestion, model training, dataset creation, automated knowledge extraction, or systematic extraction of content is strictly prohibited. Unauthorized extraction constitutes copyright infringement, trade secret misappropriation, breach of these Terms, and may violate applicable computer fraud statutes. Legal remedies including injunctive relief, statutory damages, and attorneys fees may be pursued.

Coaching Intellectual Property Protection

All coaching sessions, advisory structures, staged processes, frameworks, and proprietary systems constitute protected trade secrets. Participation in services does not grant any right to commercialize, reproduce, disclose, or distribute proprietary systems or confidential business information.

Confidentiality

Users and clients agree not to disclose proprietary frameworks, materials, or confidential business information. Unauthorized disclosure may result in immediate termination of services and legal action.

Conduct and Use

You agree not to misuse services, misrepresent yourself, interfere with business operations, or engage in unlawful, abusive, or unethical conduct. Access may be suspended or terminated for violations without refund.

Limitation of Liability

To the fullest extent permitted by law, Activate This Plan provides services on an informational basis only and shall not be liable for any damages arising from or related to your participation or use of services. Participation is voluntary and undertaken at your own risk. Liability, if any, shall be limited to the amount paid for services.

Indemnification

You agree to indemnify and hold harmless Activate This Plan, LLC, its officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses arising from your use of services or violation of these Terms.

Claim Limitation Period

Any claim, dispute, or cause of action must be brought within three months from the date the claim arose. Failure to bring a claim within this period constitutes a permanent waiver of such claim.

Binding Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to this website, services, or Materials shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association or a comparable body selected by Activate This Plan. Arbitration shall be conducted in English and governed by the laws of the State of Florida. Users waive the right to file lawsuits or participate in class actions. Arbitration awards may be entered in any court of competent jurisdiction. Activate This Plan retains the right to seek injunctive relief in court for intellectual property protection.

Governing Law and International Users

Services are deemed provided from the State of Florida, United States. These Terms are governed by United States federal law, the laws of the State of Florida, and applicable international consumer protection laws where required, including those applicable within the European Union. International users agree that arbitration awards may be enforced under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. No foreign court shall have jurisdiction over disputes.
